1. Agreement to these terms
These Terms & Conditions are a binding agreement between you and the Atlas project operated by Evan Uster. In these terms, “Atlas,” “we,” “us,” and “our” refer to the Atlas project. “Services” means the Atlas website, waitlist, software, public beta, communications, and related features.
By accessing the Services, joining the waitlist, creating or using an account, or otherwise using Atlas, you agree to these Terms & Conditions and the Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility and authority
You must be legally capable of entering into this agreement. If you are under the age of majority where you live, your parent or legal guardian must review and agree to these terms on your behalf where required by law.
If you use Atlas for a company, school, organization, or another person, you represent that you have authority to accept these terms and act on their behalf. You may not use Atlas if applicable law prohibits you from receiving or using the Services.
3. Waitlist and beta access
Joining the waitlist does not guarantee beta access, a particular release date, continued availability, or any specific feature. We may decide when, whether, and to whom access is offered.
Atlas is under active development. Features may be incomplete, inaccurate, unavailable, changed, limited, suspended, or removed without notice. Data may be lost or reset during testing. Do not rely on the beta as your only record, backup, or method for completing important work.
Staged product imagery. Product screenshots and demonstrations shown on this website are staged and use fictional or sample names, projects, files, agents, tasks, approvals, messages, dates, prices, contacts, and results. Product imagery in other Atlas marketing materials may also be staged. These materials illustrate workflows Atlas is designed to support and may be capable of performing when properly configured. They are not records of real customer activity, promises of a particular output, or guarantees that every feature shown is currently available, complete, or will remain unchanged. Actual capabilities depend on the beta version, your configuration and permissions, connected providers, and third-party availability.
4. Accounts and access credentials
You are responsible for activity under your account and for keeping credentials, access links, API keys, and connected-account permissions secure. Do not share access with anyone who is not authorized to use it. Notify us promptly if you believe an account, credential, or connection has been compromised.
You must provide accurate information and may not impersonate another person or misrepresent your authority. We may set or change usage limits, technical requirements, or access conditions to protect the beta and its users.
5. Permitted use
You may use Atlas only for lawful purposes and in accordance with these terms, the policies of connected providers, and any instructions or limits presented in the Services. You are responsible for the requests you make, the content you submit, the accounts you connect, the approvals you give, and the results you choose to use.
6. Prohibited conduct
You may not use Atlas, directly or indirectly, to:
- violate any law, regulation, court order, contractual duty, or third-party right;
- harm, threaten, harass, exploit, defraud, discriminate against, or unlawfully monitor any person;
- create, distribute, request, or facilitate child sexual abuse material or any sexual exploitation of minors;
- develop or deploy malware, ransomware, credential theft, phishing, spam, destructive code, denial-of-service attacks, or unauthorized surveillance;
- gain unauthorized access to an account, system, network, model, dataset, or service, or help another person do so;
- bypass approvals, permissions, rate limits, usage limits, security controls, safeguards, or restrictions;
- probe, scan, test, reverse engineer, decompile, or extract source code, models, prompts, or non-public components except where applicable law expressly permits it;
- submit content or connect accounts you do not own or have permission to use;
- infringe privacy, publicity, intellectual property, confidentiality, or other rights;
- use automated methods to scrape, copy, resell, or overload the Services;
- misrepresent AI-generated content as human-generated when disclosure is required by law or necessary to prevent deception;
- make fully automated decisions about a person’s employment, housing, education, credit, insurance, legal rights, medical care, or access to essential services without appropriate legal authority, safeguards, and meaningful human review; or
- use Atlas in a safety-critical system where an error or delay could reasonably cause death, personal injury, significant property damage, or serious environmental harm.
You may not help another person violate these restrictions. We may investigate suspected misuse and preserve or disclose information when reasonably necessary for security, safety, legal compliance, or enforcement.
7. User content
You retain the rights you have in prompts, files, instructions, project information, and other content you submit to Atlas (“User Content”). You represent that you have all rights, permissions, and lawful authority needed to provide the User Content and direct its processing.
You grant Atlas a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, format, process, and otherwise use User Content only as reasonably necessary to provide, secure, support, and improve the Services, comply with law, and enforce these terms. This licence ends when the content is deleted from active systems, except for limited backup, security, legal, and recordkeeping copies.
You are responsible for maintaining your own copies of important User Content. Do not use the beta as your only storage system.
8. Connected accounts and third-party services
Atlas may allow you to connect or direct third-party AI providers, applications, websites, APIs, or accounts. You authorize Atlas to send instructions and information to those services and receive information from them as needed to carry out your request.
Your use of a third-party service is governed by that provider’s terms, privacy policy, pricing, limits, and security practices. You are responsible for charges, permissions, data use, and activity associated with your connected accounts. Atlas does not control and is not responsible for third-party services, their availability, their output, or changes they make.
You may disconnect a service, but disconnection may not delete information already processed by that provider.
9. AI-generated output
Artificial intelligence can produce incorrect, incomplete, outdated, biased, offensive, or misleading output. Similar or identical output may be generated for other users. Output may not be unique or protected by intellectual property rights.
You must evaluate output before relying on it, publishing it, sharing it, or using it to take action. Atlas does not provide legal, medical, financial, tax, accounting, employment, safety, or other professional advice. Obtain qualified professional advice when appropriate.
You are responsible for determining whether output is accurate, lawful, appropriate, and suitable for your intended use, including whether disclosure, attribution, consent, or human review is required.
10. Actions, approvals, and human oversight
Atlas may help agents plan or perform actions across connected services. Approval controls reduce risk but cannot eliminate it. You are responsible for reviewing the proposed action, destination, content, scope, and consequences before approving it.
Do not approve an action you do not understand. Maintain independent safeguards for financial transactions, publication, deletion, access control, account changes, communications, and other consequential actions.
11. Atlas intellectual property
The Services, including Atlas software, workflows, interfaces, designs, text, graphics, branding, and underlying technology, are owned by Atlas or its licensors and are protected by intellectual property and other laws. Except for the limited right to use the Services under these terms, no right or licence is granted to you.
You may not remove ownership notices, use Atlas branding in a way that suggests endorsement, or copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Services except with written permission or where applicable law expressly allows it.
12. Feedback
If you provide suggestions, ideas, bug reports, or other feedback, you grant Atlas a perpetual, worldwide, irrevocable, royalty-free right to use, modify, publish, and incorporate that feedback without restriction or compensation. Do not submit feedback that you are not permitted to provide.
13. Privacy
Our Privacy Policy explains how personal information is collected, used, disclosed, retained, and protected. By using the Services, you acknowledge the practices described there.
14. Communications
By joining the waitlist, you consent to receive early access and product communications from Atlas. You can unsubscribe from promotional messages at any time. We may still send messages required to administer access, respond to you, enforce these terms, or address security and legal matters.
15. Suspension and termination
You may stop using Atlas at any time. We may restrict, suspend, or terminate access immediately if we reasonably believe it is necessary to protect users, Atlas, connected services, or the public; investigate suspected misuse; comply with law; prevent harm; or address a violation of these terms.
We may also discontinue all or part of the beta for product or operational reasons. Where practical, we may provide notice, but we are not required to do so when immediate action is reasonably necessary.
16. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Atlas disclaims all express, implied, statutory, and collateral warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted or error-free operation.
Atlas does not warrant that the Services, AI output, or third-party services will meet your requirements, preserve data, produce a particular result, or be free from harmful components. Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.
17. Limitation of liability
To the maximum extent permitted by law, Atlas and its operator, contributors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, opportunity, goodwill, use, data, or security, arising out of or related to the Services, AI output, connected accounts, third-party services, or these terms.
To the maximum extent permitted by law, the total aggregate liability of Atlas and the other parties listed above for all claims arising out of or related to the Services or these terms will not exceed the greater of: (a) the amount you paid directly to Atlas for the Services during the 12 months before the event giving rise to the claim; or (b) CAD $100.
These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not limit liability that cannot legally be excluded or limited, including rights available under applicable consumer protection law.
18. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Atlas and its operator, contributors, licensors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your User Content, your use of the Services, your connected accounts, your violation of these terms, or your violation of another person’s rights.
This obligation does not apply to the extent a claim results from Atlas’s own unlawful conduct or where applicable law does not permit the obligation.
19. Governing law and disputes
These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Before starting a formal claim, you agree to contact us and make a good-faith effort to resolve the dispute informally for at least 30 days.
Unless applicable law requires otherwise, the courts located in Toronto, Ontario will have exclusive jurisdiction over disputes arising from these terms or the Services. Nothing in this section removes rights you cannot waive under the law that applies where you live.
20. Changes to the Services or these terms
We may update the Services and these Terms & Conditions as Atlas develops, risks change, or legal requirements evolve. The effective date will be updated when these terms change. If a change is material, we may provide additional notice through the website, beta, or email.
Your continued use after updated terms take effect means you accept them. If you do not agree to an update, stop using the Services.
21. General terms
These Terms & Conditions and the Privacy Policy form the entire agreement between you and Atlas concerning the Services and replace prior discussions or understandings about the same subject. If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue.
A failure to enforce a provision is not a waiver. You may not assign these terms without our written permission. We may assign them in connection with a reorganization, financing, transfer, or sale of Atlas. Headings are for convenience only.
Sections that by their nature should continue after termination will survive, including sections concerning ownership, feedback, disclaimers, liability, indemnity, disputes, and general terms.
